Environment Act
A number of regulations have been passed to address specific aspects of the Yukon's Environment Act . In 1997, Administrative Regulations were passed to enable the Department of Environment to fully operate the environmental protection program.
There are five major components of the regulations:
1. Application for Investigation Form
-
Using this form, any two Yukon residents can request an investigation under the Environment Act, Wildlife Act, Parks Act or parts of the Public Health Act .
-
This form must be submitted with a declaration swearing that the information contained within it is accurate.
2. Proposals Exempt from Public Consultation
-
Most proposals associated with the Environment Act have a mandatory 60-day public consultation period.
-
Some proposals are exempt because they are:
-
administrative regulations in which the public would have little or no interest, such as ones concerned with changing forms;
-
-
regulations that the public cannot change, such as parts of land claim agreements that must be made by regulation.
-
Regardless, government must still consult with people who may be affected by any proposed regulation, even ones that are included on this exemption list.
3. Notice of Permit Suspension or Cancellation
-
The regulations indicate how public notification must be carried out when an Environment Act permit is cancelled or suspended.
4. Environmental Protection Order Forms
-
These forms allow either the Minister or an Environmental Protection Officer to order actions to be taken to protect the environment or public health.
5. Environmental Analytical Laboratories
-
These laboratories analyze substances that may be harmful to the environment.
-
Such laboratories must be certified before any of their results may be used as admissible evidence in court, without further proof of laboratory credentials.
- The regulations define the criteria needed for certification.
