Pesticide Applicator Certificates and the Pesticides Regulations
Pesticides can contaminate the soil, water and air. Pesticides Regulations have been developed under the Yukon's Environment Act to protect food sources, humans, and valuable plants and animals from exposure to pesticides.
The regulations focus on proper storage, handling and use of domestic, commercial, and restricted pesticides. If you apply pesticides in the Yukon, you should be aware of the Pesticides Regulations.
The Law
You must have a Pesticide Applicator Certificate if you intend to:
- purchase, use or apply any Commercial or Restricted pesticides; or
- use or apply any Domestic pesticides within a rental dwelling in which people live, or within the buildings of or on the grounds of a school, hospital, nursing home or daycare facility.
A Pesticide Applicator Certificate is not necessary if:
- a property owner or tenant uses pesticides for agricultural production on his/her land, except when the pesticides are applied by aircraft or near an open body of water; or
- a property owner or tenant uses or applies a Domestic pesticide in the rental dwelling he or she occupies.
A certified pesticide applicator:
- may have up to four persons assist with mixing, using or applying pesticides at a time;
- must be present on the site and directly supervise any assistants when they are mixing, using or applying pesticides;
- must be at least 16 years of age and ensure that the assistant(s) are at least 16 years of age.
Keeping Records
A Certified Pesticide Applicator must keep a daily record of pesticide use or applications. These records will be used to prepare an annual summary that must be submitted to the Department of Environment no later than December 31 of each year. Daily Record of Pesticide Use forms are available from the Environmental Programs Branch upon request.
Certification
When using or applying pesticides, proof of certification must be available at all times, and may be requested by an environmental protection officer.
The Yukon has not yet developed its own certification program for pesticide applicators, but a similar certification from another Canadian jurisdiction may be recognized under the Yukon regulations. Upon request, the Department of Renewable Resources will assist pesticide applicators in obtaining certification from British Columbia.
